OK.........it is not a felony to transport fireworks into CA in small quantities. See 12700 health & safety code. A felony does NOT kick in when your rights are violated by an unlawful search and siezure. 12721 of the Health & Safety code permits fire depts. to seize fireworks. The felony kicks in when you are in possession of any combination of dangerous fireworks that have a total net weight exceeding 7,500 grains. As for law enforcement authority.....the health and safety code as well as the penal code provides the authority for the fire dept. to have law enforcent authority. Arson investigators carry gun and have the power of arrest and can make vehicle stops. Go ahead and challenge that and you see yourself in the greybar motel..........
