The law is Innocent until Proven Guilty, and it sounds like most of you have forgotten that. If he is captured, he deserves a fair trial, and if he is found guilty, then he deserves punishment Not Before. And theft, even grand theft is Not a capital offense. There is also a law against cruel and unusual punishment, you seem to have forgotten that too.
