When the so called desert protection act passed in 1994, Congress signed off on a cherry stem up Surprise Canyon. Congress dictated that the road shall be left open for vehicular access.

Also, there is a need for the road to be left open. Closing the road discriminates against the disabled and aged who cannot hike up to Panamint city.
